T&Cs - General Terms and Conditions Our general terms and conditions are binding when you place your order.
- Conclusion of contract/possibility of correction: Our online shop is an offer from Urban Pieces GmbH on the Internet. The contract is concluded with Urban Pieces GmbH, owner Kim Grömminger. The customer's order represents an offer. A contract is only concluded after acceptance on our part, at the latest when the goods are dispatched. An order is only possible if all mandatory fields marked with * in the order form are filled in. If information is missing or we are unable to fulfil the order for other reasons, we cannot accept the order. The customer will receive a corresponding message as soon as we notice the problem. Before the order is finally sent, the customer has the opportunity to correct their order. The customer receives supporting detailed information directly during the ordering process. As soon as the ordering process is completed, the customer is notified of this by an information window saying "Your order is complete and will be processed immediately". This does not constitute acceptance of the customer's offer. The order is subject to the availability of the goods. Since some of our products are handmade, deviations from the product photo are possible (e.g. color, size of the stones).

- Receipt of the order: The day on which the order is received will be communicated to the customer immediately as part of the confirmation of receipt. If we are unable to fulfill the customer's order for any reason, we cannot accept the order and the customer will be notified of this by email.
- Binding of the customer to his offer: The customer is bound to his order for 14 days from receipt of this order.
- Prices: All prices include VAT. Errors excepted. Delivery and shipping costs are not included in the purchase price. Shipping costs depend on the destination of the package. We endeavor to choose a cost-effective shipping method. For deliveries to a non-EEA country, the customer must bear all import and export costs as well as any customs duties, fees and charges. However, this must be arranged by the customer with the relevant authorities. For transfers from a non-EU country (e.g. Switzerland), any transfer costs are borne by the customer.
- Terms of payment: You can choose between the following payment options: - Prepayment by bank transfer; - Payment with PayPal/credit card; -Stripe (Giropay, EPS, Bancontact, SEPA direct debit, Klarna, Apple Pay, Google Pay, Sofort, iDeal, P24)
- Delivery/delivery period: Deliveries within Europe: Unless we inform the customer immediately that we are not accepting their order, we will deliver to the customer approximately 5 - 15 working days after receipt of the full purchase price (including shipping costs) in our account, to the specified customer address. In exceptional cases, delivery may take longer, but the customer will be informed of this immediately. Deliveries outside Europe: Unless we inform the customer immediately that we are not accepting their order, we will deliver to the customer approximately 10 - 15 working days after receipt of the full purchase price (including shipping costs) in our account, to the specified customer address. Assumption of risk : A distinction must be made with mail-order obligations (sale by dispatch): The decisive factor for the assumption of risk is whether the customer has approved or specified the method of dispatch (Section 429 ABGB) or whether a standard method of transport (rail, post, plane, ship) is used or not. If he has approved or determined this, or if it is customary in the trade, the risk passes to the recipient upon handover to the respective carrier; otherwise, the recipient only bears the risk when the goods are handed over to him by the carrier.
- Warranty: The statutory warranty period of 2 years applies to defects in the goods sold that already existed at the time of delivery. Please inform us of any complaints immediately after receiving the goods or after the defect is identified. Primary warranty remedies : However, there is no free right of choice, but the seller must first be given the opportunity to improve or exchange the goods (priority of improvement or “the second chance”). The buyer initially decides whether improvement or exchange is to be carried out in individual cases. The seller can object to this decision by arguing that the expense is disproportionate. Secondary warranty remedies : A price reduction or withdrawal only occurs if exchange or improvement is impossible, if the seller refuses to improve or exchange the goods or has not carried them out within a reasonable period of time, or if improvement and exchange cause the buyer considerable inconvenience or if they are unreasonable for the buyer for valid reasons relating to the seller. The latter must involve a serious loss of confidence in the seller’s competence. The defectiveness of the service alone is not sufficient. Returns are only possible after prior agreement. Regardless of the reason for the return, the shipping costs and the shipping risk are to be borne exclusively by the customer. We do not have to accept returns that are not prepaid. - Right of withdrawal: Customers who are consumers within the meaning of the Austrian Consumer Protection Act or similar laws in their respective countries of residence can withdraw from a distance contract (or a contract declaration made at a distance) within a period of 4 weeks from receipt of the delivery of the ordered goods. It is sufficient if the declaration of withdrawal is sent within the period without giving reasons. Saturdays, Sundays and public holidays are included in the calculation of the period. However, there are in any case 7 working days (excluding Saturdays, Sundays and public holidays) available. In the event of withdrawal, the purchase price will only be refunded in return for the return of the goods received by the customer. The goods should be returned in an unused, re-saleable condition and in the original packaging. Refunds will be made within twenty-one days from the day on which we received the goods with the completed cancellation form. For these, we use the same means of payment that you chose for the original transaction . For items that show signs of wear and tear, we will charge an appropriate fee for the reduction in value. The same applies if accessories or parts are missing when the goods are returned.
- Return costs: The costs of return shipment are borne by the customer. If the goods are returned carriage forward, we are entitled to retain or invoice an appropriate amount.
- Data processing: The customer agrees that the following personal data, namely: - name; - email address; - telephone number, will be processed for future visits to the web shop, for personalization of web shop offers.
Consent for email marketing:
With the customer's express consent (opt-in procedure), the email address will be used to send email newsletters with information on offers, news and promotions. Registration is done via a double opt-in procedure, in which the customer receives a confirmation email after registration to activate the receipt of newsletters.
The customer has the option to revoke the receipt of email newsletters at any time. This can be done by clicking on the "unsubscribe" link in each email. After revocation, the email address will be immediately removed from the mailing list and no further marketing emails will be sent.
Consent for SMS marketing:
With the customer's express consent (opt-in procedure), the telephone number will be used to send SMS messages with information about offers, news and promotions. This consent can be obtained in a separate form on the website. Registration for SMS marketing takes place via a double opt-in procedure, in which the customer receives a confirmation SMS to activate the receipt of messages.
The customer has the option to revoke the receipt of SMS messages at any time by clicking on the unsubscribe link. After revocation, the telephone number will be immediately removed from the mailing list and no further SMS advertising messages will be sent.
Data transfer:
For the technical implementation of SMS and email sending, Urban Pieces GmbH may involve third parties with whom appropriate data protection agreements have been concluded. This data is used exclusively to provide the services described and is not passed on to third parties.
Data storage period:
The telephone number and email address will be stored for the duration of the consent. As soon as the customer unsubscribes from receiving SMS messages or email newsletters, the data will be deleted immediately, unless statutory retention periods prevent this. - Retention of title: The goods remain the property of the seller until the purchase price has been paid in full.
- Place of jurisdiction and applicable law: Place of performance and place of jurisdiction is Vienna, the place of jurisdiction for consumers remains unaffected. Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods, and mandatory consumer protection provisions of the state in which the consumer habitually resides remain unaffected.
